Kalchakra’s Impact: DGCA gets strict with Directors of Foreign Origin


Airlines to lose operator’s permit if Directors of foreign origin with no security clearance not removed immediately: DGCA

As an impact of the matter taken up by Kalchakra regarding the security clearance of Capt. Hameed Ali of Jet Airways, the Ministry of Civil Aviation was forced to write to all the airlines to abide by its letter dated 23 March 2018. As per the letter (see pic) the airlines were told to remove all the Directors (foreign nationals) on their board, within 30 days, who have been appointed without prior security clearance, failing which their aviation operations would be suspended.

Readers may recall that the violation of Capt. Hameed Ali COO/CEO, Jet Airways, who is a Bahrain national, was raised by Kalchakra. The matter which started from a RTI application went up to the Delhi High Court, which directed the ministry to ensure the compliance.
The letter points out that there have been instances where airlines have appointed directors on their boards ignoring the civil aviation requirements (CAR), despite sensitising them from time to time.

Jet Airways had appointed Capt. Hameed Ali as its COO in 2007 and as per the RTI reply, there was no information available with the Ministry of Civil Aviation and the matter was referred to the Ministry of Home Affairs. After the High Court’s order dated 27 July 2017, the MHA wrote to Kalchakra on 1 September 2017 that the security clearance was given to Capt. Hameed Ali on 25 July 2014. This was certainly a clear violation of the CAR. But the ministry and the DGCA took no punitive action against Jet Airways for this gross violation. How could Jet Airways got away with such serious lapses on its part.
Subsequently, Mr. Vinay Dube (US citizen), has been appointed the new CEO of Jet Airways, on 9 Aug 2017. We presume this was done after obtaining the mandatory clearances?
One has to wait and watch for the next move of DGCA, whether it takes strict actions against airlines violating this rule or not?
